Recently, MIA meetings and the Department of Home Affairs have provided critical updates regarding student visas, employer-sponsored visas, and investment migration.

 

🎓 Stricter Student Visa Scrutiny

🔹 The Department of Home Affairs is conducting stricter checks on student visas, focusing on:

  • Whether students are attending classes and completing assignments

  • The authenticity of submitted student visa application materials

🔹 3,007 student visas have been canceled due to non-genuine student status, including failure to meet attendance requirements!

🔹 Common Violations:

·         Fake student status, skipping classes ➡️ Risk of COE cancellation or even deportation

·         Long-term absence from classes ➡️ If absent for over 2 months, leaving Australia first is the safest option

·         Graduated but still holding a student visa ➡️ Must apply for a new visa (485 work visa, new student visa, PR application, etc.) within 3 months

·         Holding a student visa while planning to switch ➡️ Continue attending classes and paying tuition until a new visa is lodged

👉 Reminder: Maintain student status and comply with visa conditions!

 

🏢 Employer-Sponsored Visa Updates

🔹 482 Employer-Sponsored Visa

  • Old 482 processing is slow, replaced by new 482 SID

  • New 482 SID is faster, requiring only 1 year of work experience!

  • High demand from employers, ideal for IT, accounting, and other competitive fields

  • 186 PR sponsorship is also being optimized, discussions ongoing

 

💼 Investment & Innovation Visas

🔹 SIV (Significant Investor Visa) is the slowest to process—applicants should be patient🔹 New NIV investment category

  • Not a traditional investment visa but an entrepreneurial innovation visa

  • South Australia is uncertain about its nomination requirements, while Queensland has clearer guidelines

 

⚖️ Visa Processing & Cancellation Issues

🔹 Unjustified visa refusals and slow processing are under discussion🔹 No conclusive resolutions yet🔹 Upcoming elections could impact immigration policies

  • If Labor wins: Policies may continue fluctuating—tightening and loosening unpredictably

  • If the Liberal Party wins: Likely to prioritize skilled migration, investment migration, and regional migration
